Why did the HOA wait so long to fix the porch, leading to major water damage in the basement and foundational issues, and can they prioritize this urgent repair before more rain hits?

We had some major water damage in our basement after the HOA replaced our porch at the beginning of the summer. We never had a sagging ceiling until we discovered water damage coming through. The walls and ceiling had to be demoed, and we found some foundational issues as well. It’s been a waiting game since the water damage came through on Jan 29th, especially with all the rain we’ve been getting. I just want them to pull the porch now so we can stop the water from coming in. I know we won’t get a new porch right away, but can they at least start fixing it and wait to pour the cement? I’m starting to see some dampness on the plywood flooring in the basement now.
I have a restoration company and deal with damages caused by HOAs frequently. They tend to take their time, so don’t expect them to act quickly. If you let them, they could leave things as they are for up to a year. They are also responsible for mold remediation and rebuilding your room. As the owner, you have the option to choose the companies that work on your property. I recommend getting estimates from restoration companies right away, sharing them with the HOA, and demanding immediate action. If they fail to act, consider consulting an attorney to send a demand letter to the HOA. That usually gets results. It’s crucial to address the floor-to-ceiling mold remediation now and emphasize that it’s a health emergency, especially if there are kids or immunocompromised individuals present.
Is indeed taking their time, which is frustrating. We have two children, ages 4 and 2. Our 2-year-old has been in and out of the hospital due to breathing difficulties and was diagnosed with asthma in December. The situation in the basement sheds light on why this has been happening.
You should consider hiring a lawyer.
