If you’re silly enough to place a panel there, then yes, you should either get a refund or relocate it. Can you turn it around to face the opposite direction?
Just put in a new tank. At some point, an inspector had to approve that tank before it could go there in the first place. Sometimes there’s limited space and the water level isn’t above the panel. The panel can still be opened. It’s a tough decision.
I would expect the panel to be there before the HWT, otherwise OP must be not very smart

I think the code mentions that water lines can’t be directly above or in front of an electric panel. And if the panel and tank were already there, what more can the plumber do?

Any reason why you can’t request a retroactive permit? Did you do everything correctly? They might complain, but as long as it’s done right, they won’t reject it… just remember to stay at least 3 feet away from the panel.

Which came first, the water heater or panel? 😆 I recommend upgrading to a tankless water heater mounted on the far wall. Do you already own a used Rheem tank? If the tank was there first, it must have been a pain terminating the wires.

The real question is, what is good about it?
If you placed the panel with the water heater in place, then that responsibility falls on you. If the water heater was installed afterwards, advise them to relocate it.
Here are 3 issues to consider: 1. Insufficient clearance around the panel. 2. Lack of a disconnect for the water heater. 3. Missing cover for the light switch.

The panel needs to be at least 3 to 6 feet away from the hot water heater.
Selling the house in its current condition would not be possible without addressing potential code violations.

It would have been better to have a conversation with the customer and explain the situation regarding the permit beforehand to manage expectations.

I assume the panel was placed after the water heater?? Having a 3ft workspace is taught early on in training, or it should be. If that’s the case, then it’s entirely your fault and you must find a solution. If the water heater was installed after the panel, you need evidence of dates and then the plumber is accountable for relocating it.
